Subject: Implementation of Rotational Transfer Policy in respect of officers of the Central Secretariat Service (CSS) in all grades.

 

The Rotational Transfer Policy of CSS officers prescribes a fixed tenure of posting for an officer of the Central Secretariat Service in a particular Ministry/Department. One of the objectives of the Rotational Transfer Policy is gaining of exposure by the officers to different challenging situations in varied Ministries / Departments which will not only help them individually to progress in their career but result in the betterment of the administrative system as a whole.

 

2. The DOP&T is planning to effect transfers of CSS officers in all grades, who are due for transfer as on 1.1.2012, under the Rotational Transfer Policy during the year till 31st December, 2012 in a phased manner as per the following schedule:

Subject: Extension of Risk Allowance till 31.12.2011.

           The undersigned is directed to refer this Departments OM No.21012/01/2008-Estt.(AL) dated 19.07.2011 vide which payment of Risk Allowance was extended till 31.12.2011. Extension of Risk Allowance for a further period of six months beyond 31.12.2011 has been considered and it has been decided that Risk Allowance may be continued at the existing rates for a further period of six months upto 30.06.2012 or till such time Risk Insurance Scheme is implemented, whichever is earlier.

Subject : Clarification on application of the DOPT's OM No. 7/7/2008-CS.I (A) dated 22.12.2010 and 18.03.2011 regarding stepping up of pay of Senior Assistants of CSS on/after 1.1.2006 vis-a-vis notional fixation of pay.

             Attention is invited to this Department's OM of even number dated 22.12.2010 and 18.03.2011 on the above subject. Subsequently, Ministries/Departments have sought clarifications on the same subject, the details of which have been listed as under :

Whether the grades of Assistants and SOs of CSS are centralized for the purpose of stepping up of pay allowed as per this Department's OM No. 7/7/2008-CS.I(A) dated 22.12.2010 and 18.03.2011?

Yes, For the two purpose as mentioned in the OM No. 7/7/2008-CS.I (A) dated 22.12.2010 and 18.03.2011, the cadres of the grades of Assistants and SOs are centralized.

Whether the Notional fixation of pay allowed in the grades of Assistants and SOs of CCS of certain Select List vide this Departments' OM No. 6/3/2009-CS.I (S) dated 09.07.2010 is mandatory or optional ?


The section Officers/Assistants are allowed an option to have their pay fixed from the date of their actual promotion or from 1st July of the Select List year. The option would apply to all such officers covered by the OM No. 6/3/2009-CS.I (S) dated 09.07.2010, irrespective of the fact whether they are included in the Select List from Seniority or the Departmental Exam stream.

Whether pay of the SOs of CSS belonging to LDCE quota for the years 2004 and 2005 who actually took charge as Section Officers after 2.1.2006, but were working as regular Assistants on 02.01.2006 is to be stepped up with that of Shri. Rajen Kabui who was appointed as adhoc Assistant w.e.f.02.01.2006 ?

Claims of Section Officers who opt to have their pay fixed in the grade of Section Officers from the date of actual appointment for stepping up of pay may be examined in the light of instructions already issued by this Department / Department of Expenditure vide OM No.7/7/2008-CS.I (A) dated  22.12.2010 and 18.03.2011.

 

2. This issues in consultation with Establishment (Pay) of this Department.

3. All the Ministries/Departments are requested that necessary action may be taken in line with the clarification as stated above.

Subject: Guidelines regarding grant of ‘Vigilance Clearance’ to members of Central Civil Services / Posts.

The undersigned is directed to say that it has been decided by the Government that officers who have not submitted the Annual Immovable Property Returns by the prescribed time would be denied vigilance clearance and Will not be considered for empanelment for senior level posts in Government of India.

2. Accordingly, in this Department’s OM No. 11012/11/2007-Estt.A dated 14.12.2007, laying down guidelines regarding grant of vigilance clearance to members of Central Civil Services / Posts, in para 2 a new sub-para (f) will be inserted as under:

(f) Vigilance clearance shall be denied to an officer if he fails to submit his annual immovable property return of the previous year by 31st January of the following year, as required under Government of India decisions under Rule 18 of the Central Civil Services (Conduct) Rule, 1964.

Subject:- Extension of Risk Allowance till 31.12.2011.


             The undersigned is directed to refer this Department’s OM No.21012/0l/2008-Estt.(AL) dated 25-01-2011 vide which payment of Risk Allowance was extended till 30-06-2011. Extension of Risk Allowance for a further period of six months beyond 30-06-2011 has been considered and it has been decided that Risk Allowance may be continued for a further period of six months upto 31-12-2011 or till such time Risk Insurance Scheme is implemented, whichever is earlier. Clarification on Children Education Allowance

Subject: - Clarification on Children Education Allowance.

The undersigned is directed to refer to DOP&T O.M. No.12011/03/2008-Estt(Allowance) dated 02-09-2008 and clarificatory OM No.12011/16/2009-Estt.(AL) dated 13.11.2009 on the Children Education Allowance(CEA) Scheme, this Department has been receiving references from various Departments seeking further clarifications. The doubts raised are clarified as under:

 

  (i) whether Children Education Allowance would be admissible beyond two children due to failure of sterilization operation.

 

  The reimbursement of Children Education Allowance is admissible only for the first child born after failure of sterilization operation

 

  (ii) whether the admissible amount per annum per child (annual ceiling of Rs.15000/-) on account of CEA can be reimbursed in full in the first quarter of the financial/academic year itself

 

  It is clarified that a Government servant is allowed to get 50% of the total amount subject to the overall annual ceiling in the first quarter and the remaining amount in third and or fourth quarter. Frontloading of the entire amount in the first and second quarters is not allowed.

  (ii) A Government servant claim full amount subject to annual ceiling of Rs.15000/- in last quarter.

Subject: - Preparation of Common Seniority List of UDCs for the Select List year 2006 and calling of cadre seniority list for the Select List Years 2006 and 2007 - reg.

The undersigned is directed to say that Common Seniority List (CSL) of UDCs of CSCS for the select List Year 2006 is being finalized in terms of Rule 11(3) read with Regulation 2 of Third Schedule of CSCS Rules, 1962.

2. The Cadre units are requested to circulate the list among the officials concerned inviting objection/representation, if any, with regard to any factual inaccuracy and the order of placement in the list, which may be forwarded along with the comments of the cadre units to this Department for appropriate action. Cadre units are also requested to verify the correctness of the particulars such as date of birth, date of regular appointment to the grade, rank number (in the case of officials appointed on the basis of Limited Departmental Competitive Examination) etc., of the officials in the list. It is also requested that a copy of the latest Cadre Seniority List of UDCs for the Select List Years 2006 and 2007 may also be forwarded to this department.

Subject:- Promotion of LDC as UDC of Central Secretariat Clerical Service (CSCS) on ad-hoc basis- Continuance of Ad-hoc appointments regarding.

  

The undersigned is directed to refer to this Department’s O.M. No. 3/2/2010-CS.II dated 31st December, 2010 whereby cadres were permitted to continue the ad-hoc appointments in the UD Grade of CSCS up to 30.06.2011 and to say that the continuation of the ad-hoc appointments in the U.D grade made by the cadres has been reviewed in this Department. Since availability of regular UDCs through normal modes of recruitment prescribed under the CSCS Rules may take some more time, it has been decided that the period of ad-hoc appointment of those UDCs who already have been working as UDC on ad-hoc basis in the UD Grade of CSCS may be extended up to 31st December, 2011 or till regular UDCs become available, whichever is earlier.

  

2. Other terms and conditions mentioned in this Department’s O.M. No. 3/6/2004-CS.II dated 28.2.2005 will remain unchanged.

Subject :- Fifth Review Meeting with Cadre Authorities on issues pertaining to CSS/CSSS/CSCS.

 

The undersigned is directed to say that the fifth review meeting with cadre authorities on issues pertaining to CSS/CSSS/CSCS will be held under the chairmanship of Joint Secretary (CS) between 2.3OPM and 5.OOPM on 24th June, 2011 in Room No.119, North Block, New Delhi.

 

2. The following Agenda Items will be discussed in the meeting: -

 

(I) APAR completion of all CSS officers for 2009-10 and 2010-11 and previous years and timely updating of APAR monitoring software by nodal officers.

 

(ii) Completion of CR Dossiers of Assistants/PAs who have qualified the written examination for combined LDCE 2006, 2007 and 2008.

 

(iii) Status of submission of Immovable Property Returns for 2009 and 2010.

 

(iv) Surrendering of officers by Ministries to DOP&T.

 

(v) Collection of Data/information and vigilance status for Review DPC of the Select Lists 2003 to 2008 of the grade of Under Secretary.

 

(vi) Collection of ACRs/APARs and vigilance clearance in respect of Section Officers who are in the zone of consideration for promotion to the grade of Under Secretary on ad-hoc basis.

 

(vii) Updation of CSL of PAs.

 

(viii) Completion and forwarding of recommendations of DPCs for ad-hoc promotion of PAs to the grade of PS.

 

(ix) Completion and forwarding of recommendations of DPCs for ad-hoc promotion of Steno Grade D to the grade of PA.

The undersigned is directed to refer to this Department’s OM of even number dated 29th October, 2010 and subsequent reminders dated 14th January, 2011; 14th February, 2011; 26th April, 2011 and 31st May, 2011 on the subject mentioned above.

 

2 All the cadre units were requested to keep in readiness complete ACRs/APARs in respect of officials who applied for the Combined Limited Departmental Examination 2006, 2007 and 2008. As UPSC has declared the result on 31st May, 2011, all the Cadre Units are requested to send the ACR dossiers of successful candidates to UPSC immediately on receipt of communication from UPSC in this regard. It should be noted that any delay in sending the ACRs of successful candidates to UPSC would eventually have a bearing on the posting of Section Officers in various Ministries/Departments.

MINUTES OF THE THIRD MONTHLY REVIEW MEETING WITH CADRE UNITS ON ISSUES PERTAINING TO CSS/CSSS/CSCS HELD ON 25th FEBUAEY 2011

   The third monthly review meeting with the cadre units on issues pertaining to CSS/CSSS/CSCS was held at 11. 00 AM on 25th February, 2011 under the chairmanship of JS (CS) in Room No.119, North Block. The agenda items for the meeting are at Annexure-1. The list of participants is at Annexure-II.

   2. Welcoming the representatives from the Ministries/Departments, Director (CS-I). DDP&T initiated the discussion. Before taking up the agenda items for discussion, he informed the cadre representatives that there was urgency in connection with restructuring of CSSS cadre. The DPC for promotion from PPS grade to Sr. PPS grade had been fixed for the 28th February, 2011 and that ACRs and vigilance clearance of certain officers were still awaited from some cadres. The names of the officers were intimated to the representatives of the cadres with the request to expedite the requisite documents to enable the DPC to consider the case of those officers for promotion.

   3. Director (CS-I) then explained the position with regard to the agenda items as under:

(I) Non-relieving of SOs/ad-hoc USs for level D training on the ground of official exigencies

   It was explained that the Level D training for Section Officers is a mandatory training as part of CSS Cadre Training Plan. Non-attendance of the training would affect the promotion prospects of the officers concerned. It was informed that there were 19 officers who had been nominated earlier but have not attended the Level D training. There were two officers who had been nominated thrice and one officer four times

   The Cadre Units concerned were impressed upon to relieve the officers for training as non-attendance of the training would hamper their promotion.

(ii) Inputs regarding ad-hoc promotion to SO Grade in pursuance of O.M. dated 11-11-2010

   So far, the information was still pending from two Cadre units-(i) Social Justice and Empowerment and (ii) Youth Affairs and Sports. It was decided that a communication to the two cadres would be sent at Secretary level.

(iii) Completion of CR Dossiers of Assistants/PAs who have appeared for Combined LDCE 2006. 2007 & 2008

   The Cadres were informed that the results of the Combined LDCE for 2006-2008 would likely be declared by the end of April/1 week of May, 2011 and hence all the Pending ACRs were required to be completed urgently. While the status was complete only in respect of 2 cadres (Legal Affairs, Water Resources) it was partially complete in respect of 4 cadres ( MHA, Labour Posts, Culture) All the Cadre units were requested to take appropriate action on an urgent basis.

(iv) Vacancy position in the grade of LDC for Select List Year 2010 as per amended CSCS Rules 2010

   All cadre units were requested vide OM dated 24-11-2010 to furnish the revised vacancy position in the grade of LDC for SL 2010. The requisite information was still awaited from 11 Cadre units (Commerce, Culture Earth Science, Food & PD, MHA Minority Affairs Rural development, Social Justice & Empowerment, Telecommunication, WCD, Youth Affairs & Sports)

(v) ACRs of PS up to Select List Year 2000 (General) and 2004 (SC & ST)

   The information was pending from 28 cadre units

(vi) Deletion of names of Steno Grade D appearing in CSL of the grade circulated on 28-7-2006 but who have been promoted as PA/PS on regular basis or have left service

   Cadre units were requested to furnish the required information by 31-1-2011 Despite reminder dated 8-2-2011, the requisite information was still awaited from 7 Cadre units (Corporate Affairs, Culture, Minority Affairs, DOP&T, Social justice & Empowerment, UPSC, Youth Affairs & Sports).

(Vii) Apprising the cadres on future action points emanating from CSSS Cadre Restructuring and time frame

   Joint Secretary(CS) briefed the cadre units about the action being taken consequent to restructuring of CSSS cadre such as allocation of newly created posts to Ministries/Departments making promotion to the grades of Sr.PPS. PS and PA. He urged that the cadre units Should arrange to furnish the pending ACRs/APARs urgently to enable the DOP&T to accomplish the targets in a time bounce manner.

(viii) Completion/submission of Property return in respect of CSS officers for 2010 (& prior years)

   For the year 2009, IPR in respect of 866 officers had been received. IPRs in respect of 485 officers have so far been received for the year 2010. The Cadre units were requested to issue internal circulars for expediting submission of IPRs by the officers

   JS(CS) observed that since there is a provision in the ACR/APAR form about submission of IPR, the Ministries/Departments should certify the factual position indicated by an officer in his ACR about submission of IPR

(ix) APAR completion of all CSS officers for 2009-10 and prior years and timely updating of APAR monitoring software by Nodal Officers

   It was informed that necessary training had been conducted for the Nodal Officers and a separate meeting was also held in September, 2010 for this purpose All the Nodal Officers were last reminded on 25-1-2011 to upload all the available data/status of completion of APAR by 10-2-2011. So far only 49 cadres have started feeding the data, which is incomplete. Others were asked to start feeding data in the software.

   JS (CS) mentioned that an exercise would be undertaken for the scanning of the ACRs of previous years

(x) Completion of ER Sheet data especially for Section Officers and Assistants

   The information on completion of ER Sheet data has been received from 30 Departments and is awaited from 47 Departments.

4. JS (CS) then mentioned about the following issues

   (I) Recently MHA promoted 16 Group D staff to the grade of LDC on ad-hoc basis, which was not proper. Similar action by two cadres (UPSC, Supply) has led to court cases. He asked the cadres not to resort to such ad-hoc promotions, without approval of DOP&T. He requested the representative of MHA to have this decision reviewed.

   (ii) Expressing concern about the status of implementation of the orders of transfer of officers under the Rotational Transfer Policy, he observed that despite interaction with the cadres in this regard and despite the fact that the CSS Rules provide for compliance of such orders within 45 days, the status of relieving of officers was not satisfactory. Though instructions in this regard are plenty, compliance is not uniform. He asked the representatives of the cadres to report the matter to their higher authorities concerned and for taking action for implementation of the transfer orders.

   (iii) He informed that a draft RTP for CSSS had been circulated with a time frame given for furnishing comments. He asked the cadres to go through this and furnish their comments so that the same could be finalized.

   (iv) He informed that recently USs with 16 years in a particular Ministry/Department had been transferred under the RTP. After the Parliament Session further rotational transfer of USs would be effected.

   5. Thereafter the cadre representatives were asked to explain the position with regard to their Ministries/Departments on the agenda items and also on other related issues. The status of the agenda items with regard to the Ministries/Departments as informed by them are at Annexure-III.

   6. As regards other issues/problems raised by the cadre units. the position is as under:

   6.1 Director, Ministry of Labour mentioned that 15 out of the 24 UDCs transferred to that Ministry had not joined. The representatives from the Ministry of Coal and FPI raised the question of relieving of UDCs from Urban Development. Director. MHA also raised the matter regarding relieving of UDCs from Rural Development and Department of Posts.

   On being asked about the status. Under Secretary. Ministry of UD informed that action was being taken to relieve the UDCs transferred to other Ministries/Departments

   6.2 Director MoD explained that on all the points mentioned in the agenda, the Defence Ministry had complied with all the issues. He urged that vacant posts be filled up at the earliest.

   6.3 Similarly the representative of M/o Road Transport and highways also informed that all the agenda points, action by M/o RTH had been complied with.

   6.4 Under Secretary. DIPP informed that ACRs of 9 PSs were pending from other participating offices. who were being reminded to expedite the same.

   6.5 Under Secretary. Ministry of Finance informed that of the 3 PSs nominated to that Ministry, only one had joined. Director (CS-I) suggested that they should write to the relieving Ministry/Department also, while DOPT would make efforts to get them relieved.

   6.6 Representative of Ministry of Environment and Forests mentioned that two stenographers from Ministry of I&B were yet to join. Director. MHA also mentioned about non-joining of 15 Stenographers and 2 PAs. DS(CS-ll) asked her to write to DOP&T formally so that the matter could be taken up with the Ministries concerned.

   6.7 The representative from the Ministry of Mines raised the issue of non-filling up of the vacancies in the grades of SO(6), Assistant (8). UDC (5) and stenographer (3). Director(CS-l) explained that 496 DR Assistants have been nominated but their dossiers are awaited. They would be available for posting only after August, 2011 after completion of a the pre-appointment formalities and training. which has been reduced from 16 weeks to 12 weeks. SOs would be available for posting after April/May, 2011. DS(CS-ll) mentioned that eligible LDCs can be promoted on ad-hoc basis for filling up of the vacancies of UDC.

   6.8 DS. Science and Technology mentioned that they were facing problems due to non-filling up of the vacancies in the grade of UDC and Stenographer. The representative from Department of Posts mentioned that they required UDCs to fill up the resultant vacancies of 11 incumbents who had been promoted as Assistants. DS(CS-H) suggested that a communication may he sent to DOP&T for consideration for appropriate action

   6.9 The representatives from the Ministries of Coal and Disinvestment raised the issue of non-filling up of the vacancies of Under Secretary. Director(CS-l) explained that regular panel to the grade cf Under Secretary had been held up due to litigation and that ad-hoc promotion would be made in July. 2011. Only thereafter, it would be possible for DOP&T to fill up the vacancies of Under Secretary.

   6.10 Raising the issue of officers transferred on loan basis. Deputy Secretary, Ministry of Higher Education sought issuance of guidelines by the DOP&T in this regard. Director(CS-l) explained that this was a mutual informal arrangement between the two Ministries/Departments and that DOP&T had no role in it. The lending Ministry/Department can refuse to agree to such requests keeping in view smooth management of its cadre.

   6.11 Under Secretary, WCD informed that one PPS from Ministry of Road Transport and Highways was to join. He also mentioned that the question of encadrement of one post of PPS was pending. DS (CS-II) mentioned that allocation of posts to different Ministries would be issued shortly.

   The representative from Earth Sciences mentioned about filling up of 3 posts of LDC for which a proposal for encadrement of the posts had been sent. Director(CS-l) clarified that it was not possible to fill up such vacancies immediately as there was a certain procedure which had to be completed. He informed that DOP&T would be issuing guidelines in this regard shortly. which should he kept in view by the Ministries/Departments while requesting for filling up of vacancies arising due to new creation of posts.

   7. As regards issues relating to RIP, Director MHA informed that one, Sh. DeenDayal had not yet joined. DS. Legal Affairs stated that one Section Officer transferred to Department of Expenditure would be reeved after a substitute had been provided in his place. Director(CS-l) asked him to implement the order without insisting for a substitute.

   8. A number of Ministries/Departments mentioned about the problems being faced in uploading data in the APAR software. Under Secretary RD requested for imparting training to the nodal officers of the sub-cadres. Shri BSA Padrnanabha, DS. FPI informed that they had written to DOP&T for imparting training for monitoring the APAR software. Shri Rajendra Singh. Under Secretary, Ministry of Health mentioned that the nodal officer handling the APAR software had been changed and nobody else had the password. He requested that 2/3 other officers should be provided with passwords to handle the work. The representatives from Ministry of Civil Aviation and the Ministry of Culture also asked for new password for APAR software. The representative from Minority Affairs mentioned that training was required for handling the APAR software. The representative from Supply Division informed that the nodal officer had changed and they therefore, required new password as well as training to handle the APAR software.

   It was informed that the Ministries/Departments facing problem in handling the APAR software can contact the officer concerned of NIC and that another meeting would be held in this regard.

   9. Shri Rajendra Singh. Under Secretary, Ministry of Health, raised the issue of sub-cadre units like JIPMER, writing to the DOP&T directly without consulting the main cadre unit on cadre matters, which was not proper. Director(CS-l) clarified that comments of the main cadre unit were invariably sought by the DOP&T before examining/considering such cases.

   10. Appreciating the co-operation and the response of the Ministries/Departments Director (CS-I) informed that the updates on the agendas items furnished by the Ministries/Departments would be taken on record

Subject:- Payment of fee under the RTI Act by Indian Postal Order.

The undersigned is directed to say that the Right to Information (Regulation of Fee and Cost) Rules, 2005 provide that a person seeking information under the RTI Act. 2005 can make payment of fee for obtaining information by cash or demand draft or banker’s cheque or Indian Postal Order. It has been brought to the notice of this Deportment that some pubic authorities do not accept fee through the Indian Postal Orders.

2. As stated above, one of the approved modes of payment of fee under the Rules is through Indian Postal Order. Refusal to accept tee through the IPO may be treated as refusal to accept the application. It may result into imposition of penalty by the Central Information Commission on the concerned Central Pubic Information Officer under Section 20 of the Act. All the pubic authorities should, therefore. ensure that payment of fee by IPO is not denied.

3. Contents of this OM may be brought to the notice of all concerned.

The undersigned is directed to  say that based on a demand raised  by  the  Staff  Side,  in  National  Council  (JCM), the question  of revising  the  Stitching Charges  of  Uniforms,  supplied  to Common Categories of  employees (Multi-Tasking Staff  -  erstwhile Group ‘D’  posts of  Peon, Daftry, Jamadar, Junior Gestetner Operator, Frash, Chowkidar, Safaiwala, Mali  etc. and  Staff Car Drivers,  Dispatch Riders etc.) in  the Central  Secretariat and its Attached  and Subordinate Offices, has  been examined in consultation with the Ministry of  Finance.  Consequently, it has  been decided to  enhance the  rates  of  stitching charges, with  effect from  1 st  April, 2011 thereby modifying the earlier instructions issued vide this Ministry’s O.M. No.  14/3/2006-JCA dated 28th  September, 2006.

2.  The  revised  rates  of  stitching charges,  with  effect  from  1st April, 2011, will be as under:-

3.  It  may  please  be  noted  that the reimbursement  of  Stitching Charges at the preseribcd rates  should  be  done  only  after the stitched uniforms are  produced  and are duly  stamped, with indelible ink,  a t  an  appropriate  place on  the  wrong  side  of  the  stitched  dress,  for identification.  A  proper  record  and  procedure  should  be  evolved  to ensure  that  the  employees  produce  the  stitched uniforms  within  a reasonable period (say one month) after the cloth is supplied to them.

Subject:- Annual Reports regarding Representation of SCs. STs, OBCs and Persons with Disabilities in the Central Government Services as on 1.1.2011.


The undersigned is directed to say that as per instructions contained in this Department’s O.M. No.4301 1/10/2002-Estt.(Res.) dated 19.12.2003 and O.M. No 36035/3/2004-Estt(Res.) dated
29.12.2005, each Ministry/Department is required to send following reports to this Department by 31.3.2011:-


(i) SC/ST/OIIC Report-I regarding representation of SCs, STs, and OBCs in services as on 1.1.2011;

(ii) SC/ST/OIIC Report-Il regarding representation of SCs, STs, OBCs in various grades of organized Group ‘A’ services as on 1.1.2011;

(iii) Persons with disabilities (PWD) Report-I regarding representation of persons with disabilities in services as on 1.1.2011; and

(iv) PWD Report-Il regarding appointments persons with disabilities during the year 2010.


2. The proformae prescribed for above reports are enclosed for ready reference. It is request that the reports may be sent to this Department by stipulated date i.e. by 31.3.2011. While collecting information from the attached/Subordinate offices, the concerned offices may be advised not to send information direct to this Department. The concerned Ministry/Department should consolidate the information in respect of entire Ministry /Departmcnt including the information in respect of the Attached and Subordinate Office, and send such consolidated information to this Department.


3. The Ministries/Department should ensure that the reports sent to this Department contain consolidated information in respect of the concerned Ministry/Department and its Attached and
Subordinate Offices but in respect of Pubic Sector Undertaking, Statutory, statutory, semi-Government and Autonomous Bodies. Since the information called for relates to persons and not to posts, the posts, which are lying vacant, should not be taken into account. Persons on deputation should be included in the establishment of borrowing Ministry/Department/office and not in the establishment of their parent office. Persons permanent in one grade but officiating or holding temporary appointment in a higher grade should be shown in the figures relating to the class of service in which the higher grade concerned is included. It may also be noted that figures in respect of Scheduled Castes, Scheduled Tribes, Other Backward Classes and Persons with Disabilities have to include persons appointed by reservation as well as appointed on their own merit.

      This has reference to the notification NO.1/8/09-CS.I (P) dated 17.9.2010 amending Rule 19 of CSS Rules 2009 prescribing the time limit of 45 days within which CSS officers under transfer, either on Rotational Transfer or on promotion, must be relieved of their duties in their present Ministries/Departments. It was also laid down in the CSS (Amendment) Rules 2010 that if an officer is not relieved within forty-five days or such further period as referred to in sub-rule (1). the officer shall be 'deemed’ to have been relieved by the cadre-unit in which he is working and thereafter the officer shall not be entitled to draw any salary and allowances for the period of such overstay from the cadre unit from where the cadre officer was transferred.

2.        It is noticed that some of the Ministries/Departments are not complying with the provision of the amended Rule 19 of CSS of 2010 on the pretext that references have been made by them to this Department against the transfer orders.

3.       While every effort is made to immediately reply to the aforesaid references against transfers, it is sometimes not possible to do so due to a large number of such references being received in DOP&T.

4.      Mere references being made to DOP&T against such transfer/promotion orders by some cadre units cannot be taken as a plea for non-implementation of DOP&T’s orders within the prescribed time limit. It is, therefore, once again reiterated that in case a reply from this Department, extending the time limit for relieving of the officer is not received, the Ministries/Departments must relieve the concerned officers within the original time limit.

Subject:  Review of Cadre structuring – Regarding

In pursuance of the decision taken in the 2nd meeting of the National Anomaly Committee held on 27.03.2010, a Joint Committee to examine the anomalies pertaining to the Modified Assured Career Progression Scheme (MACPS) was constituted vide Department of Personnel & Training (DOPT)’s O.M. No.11/1/2010-JCA dated 03.05.2010.

2. The issue of providing an option to organisations/cadres to have a choice for the benefits under the earlier ACPS or the MACPS was also discussed in the meeting of the Joint Committee. While the issue would require further deliberations, it is reiterated that MACPS (as was the case with the ACPS) is a fall back option in the event of promotions not taking place. Cadre structure needs to be reviewed periodically to harmonise the functional needs of the organisation and career progression of
employees. Accordingly, all concerned are advised to review the cadre structure in a time bound manner with a view to mitigate problem of stagnation.

3. All Ministries/Departments may give wide circulation to the contents of this O.M. for guidance and appropriate action in the matter.

G.S.R.-       In exercise of the powers conferred by the proviso to article 309 and clause (5) of article 148 of the Constitution, and after consultation with the Comptroller and Auditor General of India in relation to the persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rules regulating the educational and other qualifications for direct recruits for the posts which were in Group 'D' Scales prior to the implementation of the Sixth Pay Commission and have been placed in Group 'C' in Pay Band 1 (Rs. 5200-20200) plus Grade Pay of Rs. 1800/- in the Central Civil Services and Civil Posts in connection with the affairs of the Union, namely:-

1.       Short title and commencement.-

            (1) These rules may be called the Central Civii Services and Civil Posts, Group 'C' posts in Pay Band 1 (Rs. 5200-20200) plus Grade Pay Rs. 1800/- (Educational and other Qualifications for Direct Recruitment) Rules, 2011.

            (2) They shall come into force on the date of their publication in the Official Gazette.

2.       Application.- These rules shall apply to ail posts which were in Group 'D' Scales (including the posts of Record Keepers in Group 'C' in Indian Audit and Accounts Department) prior to the implementation of the Sixth Pay Commission and have been placed in Group 'C' in Pay Band 1 (Rs. 5200- 20200) plus Grade Pay of Rs. 1800/- in the Central Civii Services and Civil Posts under the Central Government and the Indian Audit and Accounts Department.

3.       Educational and other qualifications.- Notwithstanding anything contained in any recruitment rules relating to the Group 'D' posts including the posts of Record Keepers in Group 'C' in Indian Audit and Accounts Department) prior to the implementation of the Sixth Pay Commission, the educational and other qualifications required for persons to be eligible to be appointed to Group 'C' posts in Pay Band 1 Rs. 5200-20200 plus Grade Pay Rs. 1800/- by the method of direct recruitment shall be as under, namely:

            "Matriculation pass or equivalent from a recognised Board
                        or
            Industrial Training institute pass Certificate from a recognised institute".

Sub:    Rate of calculating entitlement to Earned Leave (E.L) and Half Pay Leave (HPL).


      The undersigned is directed to say that matter regarding entitlement of a Government servant, who dies while in service, to Earned Leave under Rule 27(2)(b) and Half Pay Leave Rule 29 (2) (c) of the CCS (Leave) Rules 1972 has been under consideration of this Department.

2.       At present rule 27 (2) (b) says ‘when a Government servant is removed or dismissed from service or dies while in service, credit is allowed at the rate of 2 1/2 days per completed calendar month up to the end of the calendar month preceding the calendar month in which he is removed or dismissed from service or dies in service.’

Similarly Rule 29 (c) says ‘When a Government servant is removed or dismissed from service or dies while in service, credit of half pay leave shall be allowed at the rate of 5/3 days per completed calendar month up to the end of the calendar month preceding the calendar month in which he is removed or dismissed from service or dies in service.’

3.       These rules adversely affect cases where the death of a serving Government Servant occurs on the last day of the month as the day of death is treated as his last working day. Clause (b) of sub rule (2) of rule 27 and clause (c) of sub-rule (2) of rule 29 of the CCS Leave Rules is modified as under :-

Rule 27 (2) (b) ‘When a Government servant is removed or dismissed from service, credit is allowed at the rate of 2 1 /2 days per completed calendar month up to the end of the calendar month preceding the calendar month in which he is removed or dismissed from service. When a Government Servant dies, while in service, credit of Earned Leave shall be allowed at time rate of 2 1/2 days per completed month of service up to the date of death of the Government Servant.’

Rule 29 (2) (c) ‘When a Government servant is removed or dismissed from service, credit of Hall Pay Leave shall be allowed at the rate of 5/3 days per completed calendar month up to the end of the calendar month preceding the calendar month in which he is removed or dismissed from service. When a Government Servant dies while in service, credit of Half Pay Leave shall be allowed at the rate of 5/3 days per completed month of service up to the date of death of the Government Servant.’

4.      These orders take effect from the date of issue.


5.      So far as persons serving in the Indian Audit & Accounts Departments are concerned, these orders are being issued after consultation with the C&AG of India.

Subject: - Preparation of Common Seniority List (CSL] in the Grade of LDC of CSCS for the Select List years 1996, 1997, 1998, 1999, 2000, 2001 and 2002- reg.

     The undersigned is directed to say that the Common Seniority List (CSL) of LDCs of CSCS for the Select List Years 1996, 1997, 1998, 1999, 2000, 2001 and 2002 are being finalized in terms of Section 6 of the Central Secretariat Clerical Service (Preparation of Common Seniority Lists) Regulations. 1971.

2.      The Cadre Units are requested to circulatc the list among the LDCs concerned under their administrative control inviting objections/represefltatiofls. if any, with regard to any factual inaccuracy and the order of placement in the list. It has also been noticed that the cadre units are simply forwarding the objections/representations of the officials without examining the same. The cadre units are, therefore, requested that the objections/representations may be examined by the cadre units and in case any of doubt, the same may be forwarded to this Department for clarification with their comments. Cadre units are also requested to verify the correctness of the particulars such as date of birth, date of regular appointment to the grade, rank number (in the case of LDCEs) Direct Recruits etc., of the officials in the list. If any name has been left out inadvertently, it may be brought to the notice of this Department with relevant details of his placement in the CSL. The draft CSL may be seen/downloaded on the website of this Department i.e.

3.      The Cadre Units are, therefore requested to consolidate and forward factual inaccuracies/deficiencies, if any, in the CSL of LDCs of CSCS for the Years 1996, 1997, 1998, 1999, 2000, 2001 and 2002 to this Department latest by 03.02.2011. If nothing is heard from any cadre units by 03.02.2011, it will be presumed that there is no factual inaccuracy in the CSL and it will be finalized accordingly. Objections/representations received after 03 .02.2011 will not be entertained. It is also requested that a copy of the latest Cadre Seniority List of LDCs may also be forwarded to this Department.
