Sub: Revised travel entitlements of gazetted officers on duty passes, privilege passes and post retirement complimentary passes.

     Consequent upon revision of Pay Scales on the basis of decision of the Government on the recommendations of the 6th Central Pay Commission, the question of revision of existing entitlements for travel on duty passes, privilege passes/PTOs and post-reitrement complimentary passes in the case of gazetted officers has been under consideration of this Ministry.

2. The matter has been examined and the President is pleased to decide that the entitlements of different categones of gazetted officers for travel on (i) duty and (ii)privilege passes/PTOs and post retirement complimentary passes shall be as per Annexure-1 and 2 respectively.

3. In all other respects, the extant provisions of the Railway Servants (Pass) Rules,1986 (Second Edition, 1993) will continue to apply.

4. Necessary amendment to the Railway Servants (Pass) Rules, 1986 (Second Edition,1993) shall follow.

5. The revised entitlements would take effect from 06-01-2011.

6. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

Subject:    Central Government Employees Group Insurance Scheme-1980 — Tables of Benefits for the savings fund for the period from 1.1.2011 to 31.12.2011.

      The undersigned is directed to refer to this Ministry’s O.M. No.7 (2)/EV/2009 dated 29th December, 2009 forwarding therewith Tables of Benefits under CGEGIS for the year 2010. New Tables of Benefits for the savings fund of the Scheme based on a subscription of Rs.10 per month from 1.1.1982 to 31.12.1989 and Rs.15 per month w.e.f. 1.1.1990 onwards have been prepared for the year 2011 and a copy of the table is enclosed. Another Table of Benefits for the savings fund based on a subscription of Rs.10 per month for those employees who had opted out of the revised rates of subscription w.e.f. 1.1.1990 have also been drawn up for the year 2011 and a copy of that table is also enclosed. The amounts in the Tables have been worked out on the basis of interest @ 10% per annum(compounded quarterly) for the period from 1.1.1982 to 3 1.12.1982, 11% per annum(compounded quarterly) w.e.f. 1.1.1983 to 31.12.1986, 12% per annum(compounded quarterly) w.e.f. 1.1.1987 to 31.12.2000, 11% per annum (compounded quarterly) w.e.f. 1.1.2001 to 31.12.2001, 9.5% per annum(compounded quarterly) w.e.f. 1.1.2002 to 31.12.2002, 9.0% per annum(compounded quarterly) w.e.f.1.1.2003 to 31.12.2003 and 8% per annum (compounded quarterly) w.e.f. 1.1.2004 onwards.The mortality rate under the Scheme has been taken as 3.75 per thousand per annum up to 31.12.1987 and 3.60 per thousand per annum thereafter in both the cases. While calculating the amount it has been assumed that the subscription has been recovered or will be recovered from the salary of the month in which a member ceases to be in service failing which it should be deducted from accumulated amounts payable.

2.       In its application to the employees of Indian Audit and Accounts Department this Office Memorandum issues in consultation with the Comptroller and Auditor General of India.

ORDER:
In the year 2008, the Government of India have launched a new Centrally Sponsored Scheme called “Incentive to Girls for Secondary Education”. As per the Scheme, a sum of Rs. 3000/- will be deposited in the name of each eligible girls and she would be entitled to withdraw it on reaching 18 years of age.

Salient features of the Scheme:-

(i) All SC/ST Girls who pass Class VIII and enroll in Class IX in State Government, Government Aided or Local Body Schools in the academic year 2008-09 onwards; and

(ii) All girls who pass Class VIII from Kasturba Gandhi Balika Vidyalayas (irrespective of whether from SC/ST or not) and enroll in Class IX in State Government, Government Aided or Local Body Schools in the academic year 2008-09 onwards; and

(iii) The girl should be unmarried and below 16 years of age (as on 31st March) on joining Class IX; and

(iv) The girls studying in class IX in private unaided schools and the schools run by Central Government are also excluded from the scheme.

Release of Funds:-

(i) the Government of India will release the funds in two installments every year.

(ii) the first installment will be released immediately after verifying the proposal and after obtaining the recommendation of the Grant-inAid Committee of the Ministry of Human Resource Development.

(iii) the second installment will be released after the receipt of theUtilization of Certificate on 1st installment and progress report from the State Government.

(iv) the Grants to State Governments will be remitted through Inter Government Adjustment Advice or through Banking Channel. This would include direct transfer of grants to the accounts of the beneficiaries through the banking channel.

(v) The Headmasters of the schools where the beneficiary students are studying should open Zero Balance Accounts of all the beneficiaries with the nearby State Bank of India or public sector banks.

2. In the letter first read above, the Government of India have sanctioned a sum of Rs.32,75,10,000/- (Rupees Thirty Two Crore Seventy Five Lakh and Ten Thousand only) to cover 109170 beneficiaries under Centrally Sponsored Scheme “Incentive to Girls for Secondary Education”. For 2009-10 the Government of India has requested this Government to deposit the above sanctioned amount with the State Bank of India, Main Branch, Sansad Marg, New Delhi along with the details of the beneficiaries like the name, father’s name, the name of the bank and its address, account number etc. so that the State Bank of India may issue a Fixed Deposit Certificate to the beneficiaries of the State under the Scheme.

3. The Accountant General (A&E) Tamil Nadu has reported that the amount of Rs.32,75,10,000/- (Rupees Thirty Two Crore, Seventy Five Lakh and Ten Thousand only) has been credited in the accounts of the Tamil Nadu Government. The Director of School Education in his letter 2nd read above has requested the Government to issue orders releasing the above amount to enable him to deposit the amount with State Bank of India, New Delhi.

4. The Government have carefully examined the proposal of Director of School Education and accordingly sanction is accorded for release of a sum of Rs.32,75,10,000/- (Rupees Thirty Two Crore Seventy Five Lakh and Ten Thousand only) towards the expenditure on implementing the Centrally Sponsored Scheme of “Incentive to Girls for Secondary Education” for the year 2009-2010.

5. The expenditure sanctioned in the para 4 above shall be debited to the following head of account :-

“2202 General Education- 02 Secondary Education-800 other expenditure – Schemes in the Eleventh five year plan III Centrally Sponsored – SI Incentive to girls for Secondary Education – 09 Grants in aid – 09 others” (DPC 2202-02-800-SI 0993)

6. The Director of School Education is requested to draw and deposit the amount in the State Bank of India, Main Branch, Sansad Marg, New Delhi in the Account No.30643488811 as advised by the Government of India.

7. This order issues with the concurrence of Finance Department vide its U.O.No.15/DSKM/Edn II/11, dated 22.01.2011

The undersigned is directed to refer to this Department's OM of even
number dated 10th March, 2010 forwarding copy of the Model Recruitment
Rules for Stenographers Grade II post in Non-Secretariat Organizations. The
Model RRs for the posts of Stenographer Grade I, Private Secretary, Senior
Private Secretary (Group B posts) have been reviewed in the light of 6th CPC
recommendations on revision of pay scales, instructions issued by this
Department, etc. Accordingly, the revised Model Recruitment Rules for the
same applicable to the Stenographers in Non-Secretariat Organizations which
are not part of the CSSS / RBSSS / IFS / AFHQSS or any other organized
headquarter services are enclosed as Annexure to this Office Memorandum.

2. Ministries / Departments may review the existing rules and notify the
revised rules conforming to the Model Recruitment Rules. These may also be
forwarded to all autonomouslstatutory bodies for adoption. The Ministry of
Home Affairs are also requested to forward these Model RRs to the UT
Administrations for appropriate action.

SUBJECT:    Amendment to Rule 64. 71 72 & 80 of the CCS (Pension) Rules, 1972-Issue of ‘No Demand Certificate to Govt servants.


      The undersigned is directed to say that Department of Pension and Pensioner’ Welfare vide Notification No. S.O 829 (E) dated 7th April 2010, published in the Gazette of India on 12th April, 2010 has made amendments to Rules 64 71, 72 & 80 of CCS (Pension) Rules, 1972, providing thereby to withhold 10% of the amount of Gratuity admissible to retiring Government employees who are in occupation of Govt accommodation. However, consequent upon the issue of above notification, a large number of those Government employees, who have not been allotted Government accommodation are also approaching the Directorate of Estates for obtaining ‘No Demand Certificate’. In this regard, orders dated 21.11.1963 issued by this Directorate already exist. According to these orders, in cases where a Government servant has not been in occupation of any Govt residential accommodation during the service, a reference to the Directorate Estates for the issue of ‘NDC’ to him should not be necessary.

In view of this, it is reiterated that in cases where a Govt servant has not been allotted and occupied any residential accommodation during the service, instead of approaching this Directorate, the No Demand Certificate should be issued by the administrative authority concerned after verification of their records and obtaining the declaration from the Govt servants concerned, in the form enclosed herewith and attested by a Gazetted officer.

Subject: Posting of women employees – Reg.

Sir/Madam,

I am directed to say that during the meeting of the Departmental Council (JCM) held on 27.08.2010 under the Chairpersonship of Secretary (Posts), an item regarding non-posting of women employees where basic amenities are not available was raised by the Staff side. The Staff side has stated that a number of Post Offices/RMS Offices are not having all the basic amenities and women employees are finding it difficult to work in such places. The staff side has, therefore, demanded that women employees should not be posted to such offices before ensuring basic amenities in such places.

2. It was informed to the staff side that Dte has issued instructions vide letter No. 137-12/98-SPB.II, dated 29.04.1998 to all Postal Circles advising them to avoid posting of ladies staff where basic amenities are not available in the office. It was decided in the meeting by the Chairperson that instructions on the subject be reiterated to all Heads of circles for strictly compliance.

3. In the Directorate’s letter No. 137-12/98-SPB.II, dated 29.04.1998, it was inter-alia advised to avoid posting women employees where there are no basic and essential amenities for women, Circles are, therefore, requested to scrupulously follow these instructions before women employees are posted/transferred from one work place to other. It may be ensure that women employee is transferred to an office only after ensuring that basic and essential amenities for women are available there. The Circles are also requested to identify these offices which are lacking basic amenities and take action for providing them immediately.

4.        The Railway employees who are already entitled to 1st Class Passes, shall continue to draw 1st Class Passes, irrespective of their eligibility in terms of these orders.

Sir/Madam,

Reference in invited to this Directorate letter No. even dated 14th Jul 2009 on the subject cited above which provided for the manner of filling up of GDS vacant posts in single handed branch offices and branch post offices having two or more hands.

2. Provisional appointment for a brief may be resorted to only on account of sudden death, dismissal, removal, put off duty, absorption against the departmental post of Gramin Dak Sevaks and unauthorized absence for long period in case regular arrangements cannot be made immediately.

3. In the case of posts falling vacant due to discharge form service of the GDS BPM or absorption of the GDS BPM on the regular departmental posts, efforts should first be made to fill up the posts by adjusting identified surplus GDS fulfilling the prescribed qualification & other prescribed conditions failing which action should be taken in advance to fill the vacant post of GDS BPM on a regular basis by following the prescribed procedure and following other conditions prescribed under letter No. 17-103/2007-GDS dated 14 Jul 2009. The list of all the GDS, category wise, due to be discharged from service in calendar year may also be displayed on the Department's website in the month January of each calendar year.

Read the following:

2) Government of India, Ministry of Finance, Department of Expenditure, 7/24/2007/E-IIl(A) Branch New Delhi Office Memorandum dated 22.09.2010.

ORDER:-
Government has decided to grant Adhoc Bonus equivalent to 30 days emoluments on a base of 30 days a month to all regular and temporary Government employees, employees of Local Bodies and Aided Educational Institutions including teachers on regular time scales of pay for the financial year 2009-2010.

2. Employees in Groups 'C’ and ‘D’ were paid Adhoc Bonus equivalent to 30 days emoluments subject to a ceiling of Rs.3,000/- during the year 2008-2009. Accordingly, Government direct that all regular and temporary Government employees who are on regular time scales of pay, employees of Local Bodies and Aided Educational Institutions including teachers on regular time scales of pay in C’ and D’ group be paid adhoc bonus equivalent to 30 days emoluments on a base of 30 days a month for the financial year 2009-2010. The Adhoc Bonus shall be computed on the basis of actual emoluments as on 31st March 2010. The amount of adhoc bonus shall be calculated as if monthly emoluments were Rs.3,000/- per month. In respect of those drawing pay in the pre-revised / revised scales of pay, the calculation of adhoc bonus shall be based on the emoluments drawn subject to the upper ceiling of Rs.3,000/- (Rupees Three thousand only) per month. The upper ceiling limit shall be applicable irrespective of whether the emoluments are drawn in the pre-revised or revised scales of pay.

3. Employees in Groups 'A’ & 'B’ including those coming under University Grants Commission / All India Council for Technical Education / Indian Council of Agricultural Research scales of pay and All India Service Regulations are not covered by the bonus scheme and are not entitled to get any adhoc bonus amount. Government has decided to grant Special Adhoc Bonus to these employees and direct that employees in groups 'A’ & ‘B’ including those on University Grants Commission / All India Council for Technical Education / Indian Council of Agricultural Research scales of pay and All India Service Regulations be paid Special Adhoc Bonus of Rs.1 1000/- (Rupees One thousand only).

4. The Special Adhoc Bonus of Rs.1,000/- (Rupees One Thousand only) shall also be admissible to full-time and part-time employees paid from contingencies at fixed monthly rates, employees on consolidated pay/special time scale of pay including employees in Nutritious Meal Programme! Integrated Child Nutrition Project (Anganwadi Workers), Mini Anganwadi Workers, Village Assistants on special time scales of pay, Panchayat Assistants / Clerks, Makkal Nala paniyalargal on special time scales of pay in Village Panchayats under Rural Development and Panchayat Raj Department, Contract employees, Temporary Assistants on contract basis, the employees on daily wages and the employees partly worked on daily wages and subsequently brought under regular establishment and worked continuously for atleast 240 days or more during the year 2009-2010.

5. Deputationists from the State Government working in Corporations / Boards / Joint Sector companies who are not in receipt of bonus / exgratia payment from the undertakings concerned are eligible for the benefit of Adhoc Bonus / Special Adhoc Bonus.

6. The Adhoc Bonus/Special Adhoc Bonus sanctioned in paras 2 to 5 above shall be admissible subject to the conditions prescribed in the annexure to this order.

7. The expenditure on Adhoc Bonus/Special Adhoc Bonus shall be debited to the sub-detailed head “04 Other Allowances” under the detailed head “01. Salaries” or the detailed head “02. Wages” as the case may be, under the relevant service head of the department concerned.

8. The expenditure on Special Adhoc Bonus in respect of temporary Assistants appointed on contract basis in the year 2003 shall be debited to the Detailed / Sub- Detailed head “33-Payments for Professional and Special Services” “04 — Contract Payment” under the relevant service head of the department concerned.

9. Necessary provisions have been made under the relevant heads of account in, BE 2010-2011. However, if additional provisions are required, it will be made under the relevant heads of account in RE/FMA 2010-2011 and the required funds may be drawn pending such provision.

10. This order issues with the Additional Sanction Ledger No.1700 (One thousand and seven hundred).

Subject:    Issue of Individual Plastic Cards to each CGHS Beneficiary- guidelines to pensioner beneficiaries

      The undersigned is directed to draw attention to the office memorandum of even number dated 30th December 2009 and to clarify that in response to representations received from pensioner CGHS beneficiaries, it has now been decided to partially modify para E (2 ) of the said memorandum.

Para E (2) of the Office Memorandum of even number dated 30° December 2009. which reads
as‘


The Plastic Cards ( which are identity cards ) are issued for a maximum period of Five years or till entitled for CGHS benefits. whichever may he earlier. The actual validity of CGHS Card for
availing services shall he as per records available in CGIIS Data base. In case of CGFIS pensioners who have paid for ‘Rest of Life’ facilities a new plastic Cards shall be issued after ‘Five years’ without any additional contribution. However the beneficiaries would not be denied CGHS facilities, if there is any inadvertent delay in procurement of new plastic cards after five
years, provided the beneficiary is entitled for CGHS benefits.

Subject:    Central Civil Services (Classification, Control and Appeal) Rules, 1965 —Advice of the Union Public Service Commission (UPSC) to be communicated to the delinquent Government servant along with the final order of penalty.

      The undersigned is directed to refer to the provisions of rule 32 of the Central Civil Services (Classification, Control and Appeal) Rules, 1965 and to

say that the nature of consultation with the Union Public Service Commission (UPSC) and the manner of communication of the advice of the UPSC to the delinquent Government servant have

been subject matter of litigation in some cases in CAT/High Courts etc. The questions raised from time to time are whether consultation with the UPSC under Article 320 (3) (c) of the

Constitution is mandatory and binding on the appropriate authority; and whether a copy of the UPSC’s advice should be furnished to the Charged Officer before the order imposing a penalty

is issued. The Hon’ble Supreme Court of India has finally decided the matter in its judgment dated the 19th April, 2007 in Civil Appeal No. 2067 of 2007 (Union of India and Another vs. T.V.

Patel).

2. In the above judgment, the Hon’ble Supreme Court referred to the cases of State of U.P. vs. Mandbodhan LaI Srivastava (Constitution Bench of the Hon’ble Supreme Court) [1958 SCR

533] and Ram Gopal Chaturvedi vs. State of Madhya Pradesh (three Judge Bench) [1969 (2) 5CC 240] and did not agree with the contentions on behalf of the respondent that non-supply of a

copy of the advice tendered by the UPSC before the final order was passed deprived the delinquent officer of making an effective representation and that it, therefore, vitiates the order The

Hon’ble Supreme Court held as follows :-

      “In view of the law settled by the Constitution Bench of this Court in the case of Srivastava (supra) we hold that the provisions of Article 320(3)(c)

of the Constitution of India are not mandatory and they do. not confer any rights on the public servant so that the absence of consultation or any irregularity in consultation process or

furnishing a copy of the advice tendered by the UPSC, if any, does not afford the delinquent government servant a cause of action in a court of law.”

3. The judgement of the Hon’ble Supreme court in the case of S.N. Narula vs. Union of India and others [SLP(c)12188/2003], on the facts and circumstances of that case apparently did not

lay down any law. Whereas in the later judgement in T.V. Patel’s case delivered on 19.4.2007, the Appex Court has laid down law relying on two earlier decisions of the Apex Court, one of

the Constitution Bench and another of a three Judge Bench. In view of the judgment dated 19.04.2007 of the Hon’ble Supreme Court it is clear that the Disciplinary Authority is not required

to furnish a copy of the advice tendered by the Union Public Service Commission to the Charged Officer before the final order of penalty is passed.

4. All Ministries/Departments/Offices etc. are, therefore, requested to comply with the existing provisions of CCS(CCA) Rules, 1965 and bring the contents of this O.M. to the notice of all

concerned for adopting a uniform stand and to make serious efforts to get the litigation cases on this subject disposed of by the various courts on the basis of the law laid down by the

Hon’ble Supreme Court in the judgements referred to in the preceding paragraphs.

vide which all nodal officers were requested to upload the status of APAR completion in r/o the CSS officers in their Ministry/Department.

2.       2.Thereafter , a meeting with nodal officer of all Ministries/Departments to discuss the progess regarding online monitoring of APAR of CSS

officers was held on 30th september, 2010. Nodal officers were again requested vide O.M.dated 2nd December, 2010 to ensure the completion of data entry in respect of US and above level

officers latest by 10.12.2010.

3.       Since this issue is to be dicussed in the next meeting with cadre authorities in respect of CSS/CSCS/CSCS on 31.12.2010, all the nodal officers

Proceedings of the two interactive Sessions on 14th December. 2010 at 10:30 AM and 03:OO PM in Room No.72, North Block, New Delhi in connection with e-service book

The Interactive Sessions of nodal officers on e-Service Book implementation was held on 14 12.2010 at 10:30 a.m. & 3.00 p.m. in Room No.72, North Block, New Delhi under the Chairpersonship of JS(Estt.), Ms. Mamta Kundra. The officials of this Department and NIC besides the representatives from the Ministries/Departments attended the session.

2. Smt. Simmi Nakra, Director, Department of Personnel & Training, welcomed all the participants to the Interactive Sessions. The background of the e-service book project was explained to them and the benefits of the system were outlined. It was stressed that employee profiles may be generated and employee feedback may be recorded. The participants were advised to start current entries in the e-service book format along with the previous entries, which could be taken care of in a phased manner by them. This would ensure that the e-Service Books become current quickly. The Joint Secretary (Establishment), Ms. Mamta Kundra, essayed that the basic objective of the Sessions was to seek suggestions and feedback on the issues related to e-Service Book. She stressed upon the importance of service book for the employee and how the e-format would be beneficial in facilitating quicker implementation.

3. The participants were also apprised of the MIS reports generated from the system. A brief was given to the participants with regard to the requirements for the Plan Scheme and they were requested to send the information as sought in the Questionnaire and prescribed proforma immediately. Shri G. K. Gaur, Sr. Technical Director, NIC, gave a brief presentation on the responses to the questionnaire and proforma received from some Ministries. He stressed upon the fact that his sample was too small to reach to some definite conclusion. It was therefore requested that remaining Ministries/ Departments may immediately forward their responses for better appreciation of the issues.

4. During the discussion various issues were raised by the participants. The representative of Ministry of External Affairs, Shri Arun Kumar Chatterjee, highlighted the security angle of the service book data. He requested the NIC to look into this aspect to ensure that the data may not be fiddled with. He also highlighted the specific issue of frequent postings abroad in case of MEA officials and associated maintenance of their service records. It was also mentioned that the Service Books of the officials joining the ministries from outside Delhi are manual service books compared to e-Service Book here and again after completion of their tenure they would have to be provided with manual service book. It was informed that the purpose of the Plan scheme is to introduce e-Service Book throughout the Government in a phased manner and hence all employees will be covered in due course.

5. Some of the suggestions received during the session include:
The ‘Help Desk’ has to be more proactive. A ‘Call Centre’ type help desk was suggested. Details of spouse, such as working or not working, place of work, date of birth, etc., may be added in the parameters to enable the user Ministry to have firsthand knowledge of status of spouse. Name & designation of the employee should be reflected automatically on all pages once the service book is opened. Service verification page is not user friendly. Mostly the Drawing & Disbursing Officer furnishes a certificate and on the basis of it service is verified as qualifying service or otherwise. Further discussion was held on the issue of verification. NIC was requested to devise a proper system for verification of the data as there is no provision of digital signature.
LTC field is not restricted to one of the members of the family but instead names of all the members furnished in the family details are reflected. There needs to be some arrangement for e-service book to be sent electronically to the Pay & Accounts division for issuing “Qualifying Service” Certificate as well as at the time of settlement of retirement benefits. The leave format in the e-service book needs to be simplified and made more users friendly. At present it is just the replica of physical service book. The balance of leave does not reflect automatically. The previous account of leave is also not reflected. It was also decided to look at the leave format in the physical service book. Information entered in any field cannot be deleted. It was clarified by NIC that information once fed cannot be deleted. Only new information can be added

6.The participants were requested to intimate change of Nodal Officer/administrative officers/officials immediately for the security and authenticity of the data. They were informed that MIS reports generated with a perspective and the access to these would be provided to JS and above level officials in the Ministry, If the need for generation of some more reports was felt, the concerned Ministry may inform DOPT. It was also stressed that any other issues or suggestions which could not be highlighted in the Session could be mailed at eservicebook@nic.in.

7. The Ministries/Departments were requested to furnish the Questionnaire and Proforma A & B, including information in respect of attached and subordinate offices, at the earliest. For updated information on e-service book, the webpage, viz., persmin.gov.in/esbl23/html is required to be seen from time to time by the Ministries/Departments.

Subject: Recommendations of the Fifth Central Pay Commission on scales of pay of posts of Superintending Engineers and equivalent in the Organized Group ‘A’ Engineering Service.

Attention is invited to this Department’s O.M. No.22/I/2000-CRD dated June 6, 2000 containing instructions to give effect to the recommendations of Fifth Central Pay Commission (FCPC) contained in Para 50.45 of its report to convert the Non-Functional pre-revised pay scale of Rs. 4500-5700 (revised: Rs. 14300-18300) applicable to the Superintending Engineers and equivalent into a ‘Functional’ grade and to introduce a Non-Functional Second Grade in the scale of Rs.12000-16500 for the Executing Engineers and equivalent of All the Organized Group ‘A’ Engineering Services. These instructions were amended comprehensively vide this Department’s O.M. No. 22/1/2000-CRD dated December 20, 2000.

2. Certain amended provisions with regard to eligibility criteria for grant of functional grade of Rs. 14300-18300 (pre-revised) to the Superintending Engineers and equivalent prescribed in Sub-para I (ii) of this Department’s O.M. No. 22/I/2000-CRD dated December 20, 2000 were quashed by the Gauhati High Court in its Order dated April 1, 2009 in the Writ Appeal No. 7 of 2006. This decision has now been upheld by the Supreme Court also vide its Order dated February 11, 2010 in the Civil Appeal No. 1902 of 2010. These amended provisions were formulated in supersession of the original provisions contained in Sub-paras 3(a), 3(b) and 3 (c) of this Department’s O.M. No. 22/1/2000-CRD dated June 6, 2000.

3. Consequently, the Sub-para 3(a) of this Department’s O.M. No. 22/1/2000- CRD dated June 6, 2000 would now read as under:

"The ‘functional’ grade of Rs. 14300-18300 shall be applicable to the posts of Superintending Engineers and equivalent that are variously designated and included in the Organised Group ‘A’ Engineering Services. Placement of Personnel in this ‘functional’ grade will, however, be subject to actual availability of vacancies in the grade. This shall be permitted only on completion of thirteen years of regular service in Group ‘A’ and regular service of four years in the grade of Executive Engineer and equivalent including the service rendered in the Non-Functional Second Grade Or nine years of regular service in the grade of Executive Engineer and equivalent, including regular service, if any, rendered in the Non-Functional Second Grade for the Executive Engineer and equivalent in the pay-scale of Rs. 12000-16500.”


5. This issues with the concurrence of the Department of Expenditure vide its ID Note No. 32 (5) —E-III (B)/2010 dated August 11, 2010 and the Department of Legal Affairs vide its Dy. No.FTS-3054/IOA dated November 22, 2010.

Consequently the Railway Board has agreed to revised the amount. It is expected that revision would be Rs.900/-.

Subject:     Interest bearing advances/Sixth Central Pay Commission recommendation on House Building Advance-enhancement in past cases-regarding.

       The undersigned is directed to invite attention to this Ministry's O.M. No.I-17011/2(1)/2009-H.III dated 27th November, 2008 on the above subject and to say that it has been decided in consultations with Ministry of Finance to make the afore-said orders applicable with effect from 1st January, 2006. Accordingly, an enhancement of House Building Advance, if applied for, may be granted for an amount equivalent to the difference between the previously sanctioned amount and the new amount determined on the basis of pay in the pay band, in past cases, where HBA was sanctioned on or after 1-1-2006 but before 27-11-2008 subject to complying following conditions:-

(a)       The Government servant should not have drawn the entire amount of HBA sanctioned under earlier orders and /or where construction is not completed/full cost towards acquisition of house/flat is yet to be paid.

(b)       There will be no deviation from the approved plan of construction on the basis of which the original sanction of House Building Advacne was accorded. The revised cost of the original plan can, however, be considered for determining the additional amount, subject to the prescribed maximum limits.

(c)       Supplementary Mortgage Deed, Personal Bond and Sureties will be drawn and executed at the expense of the loanee.

(d)       The actual entitlement will be restricted to the repaying capacity computed on the basis of the formula laid down in this Ministry's O.M. No.I-17015/16/92-H.III. dated 17.10.2000. It should be ensured that the entire amount of advance with interest is recovered before retirement of the Government servant.

(e)      Rate of Interest: The rate of interest chargeable in such cases would be as per the slab applicable to the total sanctioned amount i.e. amount already sanctioned on or after 1-1-2006 but before 27.11.2008 plus the enhanced sanction. However, the new rate of interest would be chargeable only on collective amount that would remain outstanding on grant of enhancement so granted. Thus, the amount of HBA that has already been re-paid on old rates will not attract the fresh interest charges.

2.      However, the existing limit of maximum admissible amount of Rs.7.50 lakh for the purpose of construction/purchase of new house/flat and Rs.1.80 lakh would remain unchanged. In other words, the sum total of previously sanctioned HBA and the enhancement granted under these orders cannot exceed the aforesaid limits. In any case, not more than one enhancement is admissible to a Govt. employee.

3.       The applications for enhanced HBA should be submitted within six months from the date of issue of this order.

4.      Ministries/Departments whose branch offices are situated in the far flung areas like in case of Ministry of Defence, etc., are advised to give wider publicity to these orders through modern communication mean like facimile e-mail, web-sites etc. so that there is no occassion for any representation for extending the time limits of six months on the grounds of receiving these orders late.

Subject: Amendment in the Rajasthan Government's General provident Fund Rules, 1997.


In cxercise of the powers conferred by the provios to Article 309 of the Constitution of India and Rule 21 of the Rajasthan Service Rules, 1951, the Governor hereby makes the following rules further to amend the Rajasthan Government Servants' General Provident Fund Rules, 1997, namely :-

1. These rules may be called the Rajasthan Government Servants' General Provident Fund (Amendment) Rules, 2010.

2. They shall come into force with immediate effect.

3. In the existing clause (ii) of Rule 26, after the existing the existing words, "Director / Additional Director" and before the words "of the Department", the words, "/Joint Director" shall be inserted.
